Terms of service

By using our API or web application, you are agreeing to be bound by the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, do not use our API or web application.

Not a Person is a web application and API (the “Service”) that allows users to create videos with AI-generated actors (the “Actors”).

The Service is provided by Not a Person, a company registered in Estonia (“Not a Person”, “we”, “us” or “our”).

1. Use of the Service

1.1. In order to use the Service, you must be at least 18 years of age. If you are under 18 years of age, you may not use the Service.

1.2. You may only use the Service for lawful purposes. You may not use the Service in any way that violates any applicable law or regulation.

1.3. By using the Service, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.

1.4 In order to use the Service, you must adhere to our Etical Guidelines, annexed to this document.

2. Accounts

2.1. In order to use the Service, you must create an account.

2.2. You must provide accurate and complete information when you create your account. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure.

2.3. You must notify us immediately of any breach of security or unauthorized use of your account.

3. Billing

3.1. The Service is offered on a subscription basis (the “Subscription”). By subscribing to the Service, you agree to pay the applicable subscription fee.

3.2. The subscription fees are due and payable in advance on a monthly or annual basis, as applicable.

3.3. If you cancel your Subscription, you will not be entitled to a refund of any unused portion of the Subscription fee.

4. Content

4.1. The Service allows you to create and share videos and other content (the “Content”).

4.2. You retain all ownership rights in your Content. By sharing your Content on the Service, you grant us a license to use, reproduce, modify, publish, and distribute your Content for the purpose of providing the Service.

4.3. You are solely responsible for your Content and the consequences of sharing it on the Service.

4.4. We reserve the right to remove any Content from the Service at any time, for any reason.

5. Intellectual Property

5.1. The Service and all content and software on the Service is the property of Not a Person and is protected by copyright, trademark, and other intellectual property laws.

5.2. You may not use the Service or any content on the Service in any way that violates the intellectual property rights of Not a Person or any third party.

6. Disclaimer of Warranties

6.1. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

6.2. NOT A PERSON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

NOT A PERSON DOES NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE AT ALL TIMES, THAT THE SERVICE WILL BE FREE OF ERRORS, THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR THAT THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

7. Limitation of Liability

7.1. IN NO EVENT SHALL NOT A PERSON BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE SERVICE, EVEN IF NOT A PERSON HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

8. Indemnification

8.1. You agree to indemnify and hold Not a Person and its affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of the Service, your Content, your violation of this Agreement, or your violation of any rights of another.

9. Termination

9.1. We may terminate this Agreement at any time, for any reason.

9.2. If we terminate this Agreement, we will not be liable to you for any damages, including any loss of data or lost profits.

10. Miscellaneous

10.1. This Agreement constitutes the entire agreement between you and Not a Person with respect to your use of the Service.

10.2. This Agreement shall be governed by the laws of Estonia, without regard to the conflict of laws provisions thereof.

10.3. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect.

10.4. You may not assign or transfer this Agreement, by operation of law or otherwise, without our prior written consent. Any attempt by you to do so, without such consent, shall be void.

10.5. Not a Person may freely assign this Agreement.

10.6. The failure of Not a Person to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.

10.7. This Agreement does not create any agency, partnership, or joint venture between you and Not a Person.
