  • Customer Support Providers: We use customer support providers to help us respond to your inquiries and provide you with assistance.

4.3 Business Transfers

If Neural Actors is involved in a merger, acquisition, financing, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.

In such event, Neural Actors will endeavor to direct the transferee to use your information in a manner that is consistent with this Privacy Policy. However, we cannot promise that the new entity will have the same privacy practices or treat your information the same as described in this Privacy Policy.

If we are involved in a merger, acquisition, or sale of all or a portion of our assets, we will notify you via email and/or a prominent notice on our website of any change in ownership or uses of your information, as well as any choices you may have regarding your information.

We will also notify you of any material changes to our Privacy Policy as a result of such a transaction, as described in Section 1.3 (Changes to Privacy Policy).

5. Data Retention

5.1 Retention Periods

We retain your personal information for as long as necessary to fulfill the purposes for which we collected it, including to provide you with our Services, comply with our legal obligations, resolve disputes, and enforce our agreements. The specific retention periods depend on the nature of the information and the purposes for which it is used. We use the following criteria to determine how long we retain your information:

  • Account Information: We retain your account information for as long as your account is active. If you delete your account, we will delete or anonymize your account information within 30 days, except as noted below.
  • Payment Information: We retain payment information as required by applicable tax and accounting laws, typically for 7 years after the transaction.
  • User Content: We retain your User Content for as long as your account is active or as needed to provide you with our Services. If you delete specific User Content, we will delete it from our active systems within 30 days, but it may remain in our backup systems for up to 90 days.
  • Generated Content: We retain your Generated Content according to your subscription plan. For more information, see Section 5.3 (Generated Content Retention).
  • Communications: We retain communications with you for as long as necessary to provide you with our Services and to comply with our legal obligations. If you delete your account, we may retain certain communications, such as those related to legal matters or disputes.
  • Log Data and Analytics: We retain log data and analytics information for up to 12 months to help us understand how our Services are used and to improve our Services.
  • Marketing Preferences: We retain information about your marketing preferences until you opt out or request that we delete this information.

We may retain your information for longer periods if required by law, regulation, or legal process, or to protect our rights or the rights of others. For example, we may retain information related to legal disputes or investigations for longer periods.

5.2 Account Deletion

You can delete your account at any time by accessing your account settings or by contacting us at hello@neuralactors.com. When you delete your account, the following will occur:

  • Account Information: We will delete or anonymize your account information, including your name, email address, and other personal information, within 30 days of your request.
  • User Content: We will delete your User Content from our active systems within 30 days of your request, but it may remain in our backup systems for up to 90 days.
  • Generated Content: The retention of your Generated Content depends on your subscription plan. For more information, see Section 5.3 (Generated Content Retention).
  • Payment Information: We will retain payment information as required by applicable tax and accounting laws, typically for 7 years after the last transaction.
  • Communications: We may retain certain communications, such as those related to legal matters or disputes, as required by law or to protect our rights.
  • Anonymized Data: We may retain anonymized or aggregated data derived from your use of our Services, which cannot be used to identify you, for analytical and research purposes.

Please note that deleting your account may not immediately remove all of your information from our systems due to technical limitations, legal requirements, or legitimate business purposes. For example, we may need to retain certain information to prevent fraud, comply with our legal obligations, resolve disputes, or enforce our agreements.

If you have subscribed to our Services, deleting your account will cancel your subscription at the end of your current billing period. You will not receive a refund for any fees already paid.

5.3 Generated Content Retention

The retention of your Generated Content depends on your subscription plan:

  • Free Tier: If you use our free tier, your Generated Content will be stored for up to 30 days from the date of creation. After this period, your Generated Content may be automatically deleted from our systems.
  • Paid Subscriptions: If you have a paid subscription, your Generated Content will be stored for the duration of your subscription and for a grace period of 30 days after your subscription ends. After this grace period, your Generated Content may be automatically deleted from our systems.
  • Enterprise Plans: If you have an enterprise plan, the retention period for your Generated Content will be specified in your enterprise agreement.

You can manually delete your Generated Content at any time through your account settings. When you delete Generated Content, we will remove it from our active systems within 30 days, but it may remain in our backup systems for up to 90 days.

Please note that even after your Generated Content is deleted from our systems, we may retain certain metadata about the Generated Content, such as when it was created and basic usage statistics, for analytical and research purposes. This metadata does not include the actual content of your Generated Content.

If you delete your account, your Generated Content will be handled according to the retention periods described above, based on your subscription plan at the time of account deletion.

We recommend that you download and save any Generated Content that you wish to keep before deleting your account or allowing your subscription to expire, as we cannot recover Generated Content that has been deleted from our systems.

6. Your Rights and Choices

6.1 Access and Update

You can access and update certain information about your account directly through your account settings. For example, you can:

  • Update Your Profile Information: You can update your name, email address, password, and other profile information through your account settings.
  • Manage Your Subscription: You can view, change, or cancel your subscription through your account settings.
  • Access Your User Content: You can access, edit, or delete your User Content through your account.
  • Access Your Generated Content: You can access, download, or delete your Generated Content through your account.
  • Update Your Communication Preferences: You can update your communication preferences, including opting out of marketing communications, through your account settings or by following the unsubscribe instructions in our communications.

If you need assistance accessing or updating your information, or if you need to access information that is not available through your account settings, please contact us at hello@neuralactors.com. We will respond to your request within a reasonable timeframe.

Please note that we may ask you to verify your identity before responding to your request, to ensure that we are providing information only to the person who is authorized to receive it.

6.2 Data Subject Rights (GDPR)

If you are located in the European Economic Area (EEA), United Kingdom, or Switzerland, you have certain rights under the General Data Protection Regulation (GDPR) and other applicable data protection laws. These rights include:

  • Right to Access: You have the right to request a copy of the personal information we hold about you.
  • Right to Rectification: You have the right to request that we correct any inaccurate or incomplete personal information we hold about you.
  • Right to Erasure: You have the right to request that we delete your personal information in certain circumstances, such as when the information is no longer necessary for the purposes for which it was collected.
  • Right to Restrict Processing: You have the right to request that we restrict the processing of your personal information in certain circumstances, such as when you contest the accuracy of the information.

  • Right to Withdraw Consent: If we process your personal information based on your consent, you have the right to withdraw your consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.
  • Right to Lodge a Complaint: You have the right to lodge a complaint with a supervisory authority if you believe that our processing of your personal information violates applicable data protection laws.

We may extend this period by up to two additional months if necessary, taking into account the complexity and number of requests.

Please note that these rights are not absolute and may be subject to limitations. For example, we may not be able to delete your personal information if we are required to retain it for legal or regulatory purposes, or if it is necessary for the establishment, exercise, or defense of legal claims.

If you are not satisfied with our response to your request, you have the right to lodge a complaint with a supervisory authority in the country where you live, work, or where you believe a breach of data protection law has occurred.

6.3 California Privacy Rights (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) provides you with specific rights regarding your personal information. This section describes your CCPA rights and explains how to exercise those rights.

  • Right to Know: You have the right to request that we disclose certain information to you about our collection, use, disclosure, and sale of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:
    • The categories of personal information we collected about you;
    • The categories of sources for the personal information we collected about you;
    • Our business or commercial purpose for collecting or selling that personal information;
    • The categories of third parties with whom we share that personal information; and
    • The specific pieces of personal information we collected about you.
  • Right to Delete: You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.
  • Right to Opt-Out of Sale: We do not sell your personal information as defined by the CCPA. However, if we engage in such activity in the future, we will update this Privacy Policy and provide you with the opportunity to opt out of the sale of your personal information.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
    • Deny you goods or services;
    • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
    • Provide you a different level or quality of goods or services; or

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may make a verifiable consumer request twice within a 12-month period.

Your request must provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, and describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will respond to your request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

6.4 Communication Preferences

You can manage your communication preferences to control what messages you receive from us and how we communicate with you. You can update your communication preferences in the following ways:

  • Email Preferences: You can update your email preferences through your account settings or by clicking the "unsubscribe" or "manage preferences" link in any marketing email we send you. Please note that even if you opt out of marketing communications, we will still send you service-related and administrative communications, such as notices about your account, billing notifications, and security alerts.
  • Push Notifications: You can manage push notifications through your device settings. For example, you can turn off push notifications for our mobile application in your device's settings menu.

Please note that it may take up to 10 business days to process your request to opt out of marketing communications. Additionally, if you have multiple accounts with us or interact with us through different email addresses, you may need to update your preferences for each account or email address.

We respect your privacy and will honor your choices regarding communications. If you opt out of marketing communications, we may still send you service-related and administrative communications as necessary to provide you with our Services.

7. Data Security

7.1 Security Measures

We implement appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful processing, accidental loss, destruction, or damage. These measures include:
